Polish MEP Charged With Bribery Assumes His Seat From Custody

Włodzimierz Karpiński, a key suspect in the so-called Warsaw garbage scandal, is likely to be released from custody where he has been held for several months. The former minister is poised to fill a vacant seat in the European Parliament, a move that has sparked a mix of controversy and speculation, as it will allow him to avoid facing a justice system due to his newly gained immunity, due to his status as MEP.

Wlodzimierz Karpinski, the former Secretary of Warsaw, is currently facing corruption charges related to the infamous garbage scandal. He has been held in temporary detention since February.

Karpiński, who faced corruption charges for allegedly facilitating contracts worth 600 million PLN with the Warsaw Cleaning Company and accepting bribes of nearly 5 million PLN, was initially unsuccessful in his bid to become an MEP in the 2019 elections. However, due to post-election shifts, a seat has become available. With the passing of Riad Haidar, who was next in line, and Joanna Mucha also opting for a position in the Polish parliament, Karpiński is set to take up the role.

The former minister has expressed his intention to accept the MEP mandate, which would grant him immunity and lead to his release. His lawyer, Michał Królikowski, conveyed that Karpiński has been contemplating whether accepting the mandate would be a dignified and honorable resolution. Asserting his innocence and the lack of direct evidence against him, Karpiński believes he has the right to speak freely and intends to address the state of rule of law in Poland at the European Parliament.

This development has prompted a wave of online commentary and raises questions about the intersection of legal proceedings and political immunity, the role of MEPs in discussing national issues on a European stage, and the broader implications for the rule of law in EU member states.

“Following Krzysztof Hetman’s successful bid for a spot in the Sejm, the Polish Parliament, his position as an MEP was effectively terminated. This opened up an opportunity for Włodzimierz Karpiński, a currently incarcerated individual associated with the Civic Platform, to potentially occupy the position. “Mr. Włodzimierz Karpiński maintains the right to this mandate. He retains the right to accept it, considering he is yet to be convicted,” observed Hetman. “The proverbial adage, ‘fortune is often fickle,’ aptly encapsulates his situation.”

“In Greek mythology, we had the Augean stables. Now, in today’s context, one could refer to it as Tusk’s stable,” remarked Jan Kanthak, while discussing the case involving Włodzimierz Karpiński. Karpiński is set to become a member of the European Parliament, a move that will effectively release him from temporary detention. Kanthak, who is the Deputy Minister of State Assets and a prominent figure in Sovereign Poland party (coalition partner of the currently ruling PiS), believes the court should petition the European Parliament to revoke Karpinski’s immunity.”

“Despite my limited trust in the prosecution and even lesser confidence in the CBA under PiS governance, due to its heavy politicization, I have consistently cooperated with all law enforcement agencies,” emphasized Warsaw’s President, Rafał Trzaskowski. This statement was made in response to journalists’ queries about the Karpiński case, who worked with for Trzaskowski in the Warsaw’s City Hall.

“There is a question whether the arrest was justified in the first place. That’s what the court decided, so it’s hard for me to comment on it. I hope the case will be resolved as soon as possible by independent courts. Fortunately, today we have a guarantee that the courts will be independent,” he continued.

The leader of Poland 2050, Szymon Hołownia, described Włodzimierz Karpiński’s decision to take on the mandate of a Member of the European Parliament as “extravagant”. Although Szymon Hołownia highlighted that the move is legally sound since Włodzimierz Karpiński does not lack public rights, he nonetheless questioned its responsibility.

“The situation in which a high-ranking member of the Civic Coalition, who has been charged, becomes a Member of the European Parliament speaks not only about him but about the entire party,” says PiS MP Zbigniew Kuźmiuk in an interview with DoRzeczy.pl.

“If that happens, we will be dealing with a gigantic scandal.” – he/she adds.
