A German court has sentenced a young Afghan refugee to four years in prison for the assault of an 18-year-old Polish man at a Munich metro station. The incident, which occurred in August 2023, shocked both Germany and Poland, drawing significant attention due to its severity and timing during Poland’s national election campaign.

According to court documents, the crime took place in the early hours at Max-Weber-Platz, a largely empty metro station. The Polish victim, returning from a night out and heavily intoxicated, was resting on a platform bench when the Afghan perpetrator approached. Taking advantage of the young man’s incapacitated state, the attacker assaulted him for over half an hour. The court also confirmed that the assailant stole the victim’s mobile phone before fleeing the scene.

The perpetrator, who claimed to be born in 2005, was judged under Germany’s juvenile criminal law, which led to the relatively light sentence. Though he admitted to the theft, he denied the rape allegations throughout the trial. His legal team argued that the case had been racially and politically exploited, especially in Poland, where the government used the incident to criticize Germany’s migrant policies during the 2023 election campaign.

The assault triggered diplomatic tensions between Poland and Germany. Warsaw summoned a representative of the German embassy to discuss the case, pressing for better protections for Polish nationals abroad. The Polish government also demanded a broader public information campaign to address the risks posed to citizens traveling in Europe(

Despite the sentence, the case remains a stark reminder of the ongoing debates surrounding migrant integration and public safety in Germany. The incident, recorded by metro surveillance, also raised questions about the effectiveness of public security at transit stations(
